Subject to your compliance with these Terms, SmartCore grants you a non-exclusive, non-transferable, revocable license to install and use the Drive Video desktop application on a Windows computer for personal or internal business purposes. The Software is licensed, not sold. SmartCore retains all rights, title, and interest in and to the Software, including all intellectual-property rights.

All official releases of Drive Video are digitally signed with an Extended Validation (EV) code-signing certificate issued to SmartCore LLC. You should obtain the Software only from official channels listed on this Site or from smartxcore.com. SmartCore disclaims liability for any harm arising from modified, repackaged, or unofficial copies of the Software.

6. Automatic updates

The Drive Video application may automatically check for, download, and install updates from SmartCore's official update server. By using the Software, you consent to receiving such updates. Updates are also cryptographically verified before installation.

SmartCore does not warrant that the Software will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, SmartCore LLC, its members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising out of or in connection with your use of the Software, even if SmartCore has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of certain damages, SmartCore's liability shall be limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless SmartCore LLC, its managing members, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your violation of these Terms, your use of the Software, or your violation of any third-party rights.

This license is effective until terminated. You may terminate it at any time by uninstalling the Software. SmartCore may terminate this license immediately if you violate these Terms. Upon termination, you must cease all use of the Software and delete all copies.

13. Governing law

These Terms are governed by the laws of the State of South Dakota and the federal laws of the United States, without regard to conflict-of-laws principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in South Dakota.

We may revise these Terms from time to time. The version posted on this page is the current version; the effective date is shown at the top. Your continued use of the Software after changes constitutes acceptance of the revised Terms.
